Brunswick Show – Terms and Conditions of Entry

These Terms and Conditions apply to tickets issued for, and admission to, the Brunswick Show conducted by Brunswick Agricultural Society Inc (“the Society”, “we”, “us” or “our”).

By purchasing, accepting, holding or using a ticket, or entering the Showgrounds, patrons agree to comply with these Terms and Conditions, event signage and all lawful and reasonable directions given by the Society, event staff, security personnel and other authorised representatives.

Nothing in these Terms and Conditions excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.

1. Tickets and Admission

1. A valid ticket or other valid authority to enter must be presented when requested.
2. Tickets are valid for the number and category of patrons specified on the ticket. For example, a Family Pass admits the number of adults and children stated for that ticket type.
3. Child, concession, student, senior or other discounted tickets may be subject to eligibility requirements. Proof of age or eligibility may be requested at the gate. If satisfactory evidence cannot be provided, the patron may be required to pay the applicable admission price before entry is permitted.
4. Children aged 5 years and under are admitted free of charge, unless otherwise advertised for a particular event or ticket type.
5. Tickets must not be copied, altered, fraudulently reproduced or otherwise used to obtain unauthorised entry.
6. Where the same ticket has been duplicated or presented more than once, the Society may refuse subsequent use of that ticket after it has already been validly redeemed.
7. Tickets may only be resold in accordance with applicable law. The Society cannot guarantee the authenticity of tickets purchased through an unauthorised third party or reseller.
8. Any rules relating to pass-outs or re-entry on Show Day will be advised at the gates, on the ticket, on the Society's website or by event staff.

2. Refunds, Cancellation, Rescheduling and Event Changes

1. Tickets are not ordinarily refundable because of a change in a patron's personal circumstances, including a change of mind or an inability to attend.
2. Where the Society cancels the Show before it opens and the event is not rescheduled, ticket holders will be entitled to a refund of the amounts required to be refunded under applicable law.
3. If the Show is postponed, rescheduled, relocated or materially changed, the Society will advise ticket holders of the arrangements that apply, including any refund, exchange or other remedies available under the Australian Consumer Law.
4. The Brunswick Show comprises many separate attractions, competitions, displays, entertainment acts, demonstrations, exhibitors, livestock events and activities. The program, participants, attractions, schedules and locations within the Showgrounds may change due to weather, animal welfare, safety, operational requirements, availability or other circumstances.
5. A change to an individual attraction, competition, display, exhibitor, performance or activity will not of itself entitle a patron to a refund unless the change constitutes a material change to the event or a refund or other remedy is otherwise required by law.
6. The Society may delay, interrupt, evacuate, suspend or close all or part of the Show where reasonably necessary because of severe weather, emergency, safety concerns, government or emergency-service directions, conditions affecting the Showgrounds or other circumstances affecting the safe conduct of the Show.
7. If the Show is interrupted or closed after opening, any entitlement to a refund or other remedy will depend upon the circumstances, the extent to which the event has been provided and the patron's rights under applicable law.

3. Conditions of Entry and Patron Conduct

1. Patrons must behave in a safe, responsible and respectful manner while attending the Show.
2. Patrons must comply with: - these Terms and Conditions; - event signage; - emergency and evacuation procedures; - applicable laws; - safety requirements; and - lawful and reasonable directions given by event staff, security personnel, emergency services or authorised representatives of the Society.
3. The Society may refuse admission or require a patron to leave the Showgrounds where it reasonably believes the patron: - is intoxicated or significantly affected by drugs; - is behaving in a violent, threatening, abusive, offensive, disorderly or unsafe manner; - is endangering themselves, another person, an animal or property; - has entered or attempted to enter a restricted area without authority; - possesses a prohibited item; - has obtained or used a ticket fraudulently; - is breaching these Terms and Conditions; or - refuses to comply with a lawful and reasonable direction.
4. A patron who is lawfully refused entry or removed because of their own conduct or breach of these Terms and Conditions will not ordinarily be entitled to a refund, except where required by law.
5. Patrons must not obstruct entrances, exits, emergency access routes, roadways, pedestrian routes or access to stalls, exhibits or emergency equipment.

4. Security and Bag Inspections

1. For the safety and security of patrons, animals, exhibitors, staff and volunteers, the Society or its authorised security personnel may request to inspect bags, eskies, containers or other belongings brought into the Showgrounds.
2. Any inspection will be conducted reasonably and for event safety, security or enforcement of these Terms and Conditions.
3. A patron who declines a reasonable request for inspection may be refused entry or required to remove the relevant item from the Showgrounds, subject to applicable law.

5. Prohibited Items

1. Unless expressly authorised by the Society, the following must not be brought into or used within the Showgrounds: - illicit drugs or other unlawful substances; - alcohol brought onto the Showgrounds contrary to the Society's liquor licensing arrangements or event policy; - firearms, weapons or dangerous implements; - fireworks, flares, explosives or explosive devices; - laser pointers or similar devices capable of creating a safety risk; - glass bottles, glass containers or other breakable items where they may create a safety hazard; - drones or other remotely piloted aircraft; - unauthorised open flames, portable barbecues or other equipment creating a fire risk; - bicycles, skateboards, rollerblades, scooters or similar devices, other than mobility devices required because of disability or where expressly permitted by the Society; and - any other item that is unlawful or that event staff reasonably consider presents an unacceptable risk to patrons, animals, property or the safe operation of the Show.
2. The Society may require a prohibited item to be removed from the Showgrounds or surrendered where lawful to do so.

6. Animals and Livestock

1. Animals must not be brought into the Showgrounds unless they are: - entered in, participating in or otherwise authorised as part of the Show; - expressly authorised by the Society; or - an assistance animal permitted by law.
2. Due to the agricultural nature of the Show, livestock and other animals may be present throughout parts of the Showgrounds. Animals can behave unpredictably, particularly around crowds, noise, machinery and other animals.
3. Patrons must not enter animal pens, enclosures, holding areas or other restricted livestock areas unless expressly permitted.
4. Patrons must not feed, touch, handle or interfere with animals except in areas or activities where this is expressly permitted.
5. Patrons accompanied by an assistance animal may be given reasonable directions concerning access to particular animal, biosecurity or restricted areas where necessary for safety, animal welfare or biosecurity and permitted by law.

7. Machinery, Vehicles, Displays and Restricted Areas

1. The Show includes machinery, vehicles, equipment, livestock facilities, amusement devices and operational areas.
2. Patrons must not climb on, enter, operate, start, interfere with or cross barriers surrounding machinery, vehicles, equipment or displays unless expressly invited or permitted to do so by the exhibitor or authorised event personnel.
3. Patrons must not enter fenced, roped-off, signed, staff-only, exhibitor-only, operational or otherwise restricted areas without authority.
4. Parents and guardians should exercise particular care when supervising children around machinery, livestock, vehicles, amusement devices and operational areas.

8. Children and Supervision

1. Parents and guardians are responsible for appropriately supervising children in their care while attending the Show, having regard to the child's age and the circumstances.
2. Children participating in rides, activities, competitions or attractions may be subject to additional age, height, weight, supervision or safety requirements imposed by the relevant operator.

9. Amusement Rides, Stallholders and Independent Operators

1. The Show includes independent stallholders, food vendors, exhibitors, amusement operators and other third-party businesses.
2. Purchases made directly from an independent trader or operator are transactions between the patron and that trader or operator. Any additional terms, warranties, safety requirements or conditions imposed by that trader or operator may apply to the relevant goods, services, ride or activity.
3. Nothing in this clause limits any liability the Society has under applicable law.

10. Alcohol, Smoking and Vaping

1. Alcohol may only be possessed, supplied and consumed in accordance with applicable liquor licensing requirements, event signage and directions from authorised staff.
2. Patrons must not supply alcohol to minors or engage in any conduct prohibited by applicable liquor laws.
3. Smoking and vaping are permitted only where allowed by law and event policy. Patrons must comply with all designated smoke-free areas, signage and reasonable directions from event staff.

11. Photography, Filming and Recording

1. Photography, filming and recording may occur throughout the Show for security, operational, news, historical, archival and promotional purposes.
2. Patrons acknowledge that they may appear incidentally in photographs, video or other recordings of crowds, activities and the general conduct of the Show.
3. Where reasonably practicable and appropriate, the Society will seek consent before using an identifiable individual as the primary or featured subject of promotional material, particularly where the individual is a child.
4. Professional or commercial photography, filming, broadcasting or recording of the Show for commercial purposes requires the Society's prior approval.
5. The use of drones or remotely piloted aircraft is prohibited unless specifically authorised by the Society and operated in accordance with applicable law.

12. Personal Information and Privacy

1. Personal information collected directly by the Society will be handled in accordance with applicable law and any privacy policy adopted by the Society.
2. Where tickets are sold or processed through an external ticketing provider, payment provider or other service provider, that provider may also collect and handle personal information in accordance with its own terms and privacy policy.
3. Marketing communications will only be sent where permitted, and recipients will be given an appropriate means to unsubscribe or opt out.

13. Personal Property and Lost Property

1. Patrons are responsible for taking reasonable care of their personal belongings while attending the Show.
2. Lost property handed to the Society will be dealt with in accordance with the Society's lost-property procedures.
3. To the extent permitted by law, the Society is not responsible for loss or damage caused solely by a patron's failure to take reasonable care of their property or by the acts of unrelated third parties.

14. Safety and Inherent Showground Conditions

1. The Brunswick Show is conducted on an agricultural showground and includes crowds, animals, machinery, amusement rides, temporary structures and outdoor activities.
2. Patrons should take reasonable care when moving around the Showgrounds and be aware that conditions may include grassed or uneven surfaces, temporary pathways, cables, ramps, noise, dust, weather exposure, livestock movement, vehicles and other features ordinarily associated with a large agricultural event.
3. Patrons must take reasonable care for their own safety and the safety of people in their care and must promptly notify event staff of any serious hazard or incident they become aware of.

15. Liability and Australian Consumer Law

1. Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.
2. Subject to those rights, the Society will not be responsible for loss or damage to the extent that it is caused by: - the patron's own unlawful, negligent or unsafe conduct; - the patron's failure to comply with these Terms and Conditions or a lawful and reasonable safety direction; or - the acts or omissions of an unrelated third party for whom the Society is not legally responsible.
3. These Terms and Conditions do not exclude or limit liability where it would be unlawful to do so.

16. Emergency and Evacuation

1. In an emergency, patrons must follow the directions of event staff, security personnel and emergency services.
2. The Society may evacuate or restrict access to any part of the Showgrounds where reasonably necessary to protect health, safety, animals or property.
3. Following an evacuation or temporary closure, patrons must not re-enter a restricted area until authorised to do so.

17. General

1. If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be severed or read down to the extent necessary, and the remaining provisions will continue to apply.
2. These Terms and Conditions are governed by the laws of Western Australia.
3. The Society may publish additional reasonable event-specific conditions where required for safety, security, legal compliance or the proper operation of the Show, provided those conditions do not affect rights that cannot lawfully be excluded.
